General terms of sales and conditions

For orders from France, shipments are processed:

  • On Monday for orders placed on Fridays and during weekends.
  • On Wednesday for orders placed on Monday and Tuesday.
  • On Friday for orders placed on Wednesday and Thursday.

Orders are shipped on average within 2 days, but the period may be extended depending on the number of orders to process, if necessary you will automatically be kept informed. Lingerie Yoka Sola is not responsible for any delays in the mail once the order is shipped. Returns cost are under your responsibility. You have fifteen days to change your mind and return the ordered products in their packaging and in their original condition with their labels, new and unwashed. The orders must always be returned in order to resell it. Once we receive your order we process your refund excluding shipping cost. Note that it may take up to ten days depending on the bank for the money to be credited to your account.  Lingerie Yoka Sola delivers in France and also abroad in Europe. DELIVERIES AND RETURNS

FROM FRANCE

Orders are shipped through Collissimo. After shipping, expect 2-3 days before being delivered directly to your home: price 6 €. Deliveries are made by the post from Monday to Saturday. Delivery is made to the shipping address provided by the customer , provided that it shall be the Customer’s residence address of a physical person of their choice or a company (delivery to his business ). Delivery can not be made either in hotels or PO boxes.

Returns cost are under your responsibility. We offer an international delivery method Collissimo from 3 to 5 days in Europe in the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Denmark, Estonia, Finland, Greece, Hungary, Ireland , Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, United Kingdom, Slovakia, Slovenia, Sweden, Switzerland, Liechtenstein, San Marino, Vatican price 13 €
For deliveries in the rest of the world you contact me by email to yoka@yokasola.com. We must count fifteen working days to be delivered (e) in the rest of the world; the United States and Canada prices 24 €

Your orders are prepared with great care and shipped within 72 hours depending on the  number of orders to be shipped; you will be automatically informed. I do my best for you to have your package in a timely manner. In case of trouble or delay, please do not hesitate to contact me.

These Terms and Conditions shall, in accordance with Article L441-6 of the Commercial Code , the sole basis of commercial relationship between the parties . They apply to all orders placed on the site http://www.yokasola.com all proposed items and services . They are accessible permanently on the Site. Lingerie Yoka Sola reserves the right to change or modify at any time, the version of the terms and conditions applicable to any transaction being the one appearing online on the site http://www.yokasola.com at the time of the order. Therefore, the placing of an order implies full unreservedly these conditions.

I – CUSTOMER

While signing up with the Site and saving personal details, the Customer must ensure that all information is complete, accurate and up to date. In case of an error in the inputting of Customer details, Benda Bili will not be held responsible for any delay/impossibility of delivery.

II – PRODUCTS

The products offered for sale are those described on the site the day of consultation of the site by the user , within the limits of available stocks. Yoka Sola tries with great care to describe and present its products to better inform his client. However, it is possible that not may contain minor errors on the site, the client acknowledges and accepts .

III – ORDER

Taking orders on the Site is subject to the procedure established by Lingerie Yoka Sola materialized by a succession of steps that the Customer must follow to complete their purchase. From the moment the buyer has registered his order by clicking on the icon « I declare that I have  read and accepted the present general Terms and Conditions of Sale before placing my order » is deemed to have accepted knowingly and unreservedly these Conditions of Sale (prices, volumes and quantities of products offered for sale and ordered. A confirmation email summarizing the order (products, prices, availability, quantity …) will be sent to the Client Lingerie Yoka Sola. The customer formally accepts the use of email for confirmation by Yoka Sola Lingerie Company of the contents of the order. In any event, invoices are available in the “My Account”.  Yoka Sola reserves the right to cancel or refuse any order from a customer with whom there is a dispute over payment of a previous order. Yoka Sola recommends the buyer to keep this information on paper or computer document.

IV – PRICES AND PAYMENT

Product prices are in euros, VAT not applicable under section 293B of the CGI (French article) and excluding postage costs. The total price of the order including postage stated in the basket. Lingerie Yoka Sola has the right to change prices at any time but the products will be billed based on rates in effect at the time of registration of the order in the stocks available Products are payable on the day of the order. The settlement of purchases using either via PayPal or via our secure platform BNP Paribas or SCT partner. Customer acknowledges that the disclosure of his credit card number to Yoka Sola is authorization to debit his account to the amount of products ordered. The data recorded and stored by Yoka Sola constitute proof of the order and of all transactions. The data recorded by BNP Paribas or Paypal constitutes proof of financial transactions. PAYMENT IS MADE BY CREDIT CARD WITH THE CAPTION Visa, Eurocard or MasterCard. INVOICE PRODUCT WILL BE INSERTED IN THE PACKAGE CONTAINING THE CONTROLLED PRODUCT. In the case of a SEPA transfer your order will be shipped after the receipt of wiretransfer. Please be advised that If you order with a card from a different currency, some fees may apply according to your bank rate.

VI – RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract without giving any reason, within fourteen days. The withdrawal period ends fourteen days after the day you, or a third party other than the carrier and indicated by you, physical possession of the property. To exercise the right of withdrawal, you must notify us (by including your name, geographical address and, where available, your telephone number, fax number and email address) Your withdrawal decision of this contract through an unequivocal statement (eg letter sent by mail, fax or email). You can use the model withdrawal form, but it is not mandatory.  You can also complete and submit the model withdrawal form or any other unequivocal statement on our website http://www.yokasola.com. If you use this option, we will send immediately a receipt of a withdrawal on a durable medium (eg by email) In order for the withdrawal period is met, you only need to send your communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

Withdrawal consequences

If you withdraw from this contract , we will refund all payments received from you, including shipping (excluding additional costs arising from the fact that you have chosen , if necessary , a fashion delivery other than the cheaper model standard delivery offered by us ) without undue delay and in any event not later than fourteen days from the day we are informed about your decision to withdraw from this contract. This deadline is met if you send back the goods before the expiration of the fourteen day period .
You will have to hang to bear the direct cost of returning the goods . These costs are estimated at a maximum of about 10 € minimum.

Your responsibility is taken only in respect of the depreciation of property resulting from the handling other than those necessary to establish the nature , characteristics and the functioning of the property.

VI – WARRANTIES

The buyer is personally responsible for the development of computer technology and telecommunications to access the website http://www.yokasola.com and customer service. Explicitly, are considered as cases of force majeure or unforeseeable circumstances beyond those usually retained by the jurisprudence over the French courts, total or partial strikes, lockouts, riots, boycotts or other actions in industrial or disputes commercial, civil disturbance, insurrection, war, bad weather, epidemics, blockage of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal changes or regulatory forms of marketing, computer failure, blocking of telecommunications, including wired and wireless telecommunications networks, and other independent if the will of the parties preventing normal execution of the contractual relationship. All obligations of the parties shall be suspended for the duration of the force majeure event, without compensation. If the force majeure event continues for more than three (3) months, the contract concerned shall be automatically terminated without compensation for either party.

VIII – COOKIES

In accordance with Law No. 78-17 of 6 January 1978 relating to data, files and freedoms, the website has been declared to CNIL (Commission Nationale Informatique et Libertés) under the number 1832252 v0. All your account information is only used in the context of your business relationship with http://www.yokasola.com. This information is never shared with third parties or sold. Finally, your financial information is never in our possession. Transactions are handled entirely by Paypal or the secure payment module of our partner BNP Paribas. You have the possibility of course delete these cookies by turning their use in your browser.  You have, in accordance with national and European regulations, a permanent right to access, modify, rectify opposition with regard to information about you. IX – RESERVE OF PROPERTY

The products remain the full property of Yoka Sola until full payment , in principal , including fees and taxes.

The general conditions of sale are subject to French law.

Claims

Your request will be processed as soon as possible. We advise you to make the most possible details to your application so that it can be treated effectively. If you do not receive a reply from us within 7 days , we advise you to contact us again , some emails may be blocked by spam filters .

In case of disputes arising from the execution of this contract, Yoka Sola always try to provide solutions by way of a settlement or appeal to a mediator. The use of this latter is subject to the agreement of the parties. In the event that the parties are not submitted to the signing of an amicable agreement , jurisdiction would be seized.

X – APPLICABLE LAW AND JURISDICTION

This contract is subject to French law. The language of this contract is the French language. All disputes arising from this contract could give rise concerning its validity , interpretation, performance, termination, their consequences and their consequences will be submitted to the competent courts in common law conditions.

XI – PARTIAL INVALIDITY

If one or more provisions of these terms and conditions are held to an invalid or declared as such under any law , regulation or following a final decision of a competent jurisdiction , the remaining provisions remain in full force and effect.

XII – ARCHIVING

Yoka Sola agrees to keep every order over a sum of 120 €  for 10 years and allow the client to access the order, in accordance with Article L134-2 of the Consumer Code on archiving contracts of electronic commerce. The registers of Yoka Sola will be considered by the parties as proof of communications , orders, payments and transactions between the two parties.
